eScrip Program Terms and Conditions

As of March 15, 2005

The following Terms and Conditions apply to the eScrip Visaâ Platinum Program (the “Program”) and include provisions relating to eligibility for enrollment, accrual of eScrip Visa donations and other important conditions and limitations.  Please read these Terms and Conditions carefully.  Any use of your eScrip Visa credit card will constitute your acknowledgement of and agreement with all of the provisions specified below.

As used in these Terms and Conditions, “you” and “your” refer to any individual who is an accountholder or joint accountholder on the eScrip account (the “Account”).  National City” means National City Bank, Cleveland, OH.  eScrip” means Electronic Scrip, Inc., a California corporation.  “Donations” as used in this document is a marketing term, and is not meant to imply tax deductibility.

1.  Eligibility is restricted to individuals who are U.S. residents.

2.  You will earn one half percent (.50%) in eScrip Visa donations on the first $2,000 of annual net purchases, one percent (1%) on the next $38,000 of annual net purchases, and two percent (2%) of annual net purchases made above $40,000. “Net Purchases” means purchases of goods or services made by you or your authorized user through the use of your eScrip Visa credit card, minus merchant credits and plus or minus appropriate purchase adjustments posted to your Account.  The term “Net Purchases” does not include finance charges, annual membership fees, non-qualifying balance transfers, transactions made at a financial institution (such as purchasing gift cards or travelers’ checks or making loan payments), cash advance transactions (including access checks, ATM disbursements, and automated teller or cash equivalent item transactions), insurance premiums, debt cancellation fees, late fees, overlimit fees and other fees and charges assessed on your Account.  Annual net purchases are calculated on a calendar year basis beginning and ending with the December billing cycles.

3.  eScrip Visa donations will be awarded monthly on your Account only if your Account is in Good Standing as of the date when your statement is created.  If your eScrip Visa Account is not in Good Standing when your December statement cyles, your eScrip Visa donations will not be transferred, and such donations will be forfeited.  Your Account will be in “Good Standing” if as of such date National City determines that your Account (i) has not been closed due to non-payment, (ii) is not deemed by National City to be 30 or more days delinquent and (iii) is not in excess of the approved credit line unless authorized by National City. The maximum donation amount that may be earned is $1,000 per calendar year.

4. When your credit card Account statement is created in December of each year, National City will transfer the eScrip Visa donations earned during the previous 12 statement cycles to eScrip to process the eScrip donations for your chosen organization.  Annual eScrip Visa donations of less than $1.00 will not be transferred.

5.  Each year on your December eScrip Visa statement, you will be notified of the donation amount you earned through purchases with your eScrip Visa.

6.  National City and eScrip reserve the right to alter or change these Terms and Conditions, and to alter, change and/or terminate the Program, upon written or electronic notice to you.  In addition, National City and eScrip reserve the right to disqualify accountholders who have violated these Terms and Conditions, as they may be changed from time to time.

7.   eScrip donations earned on your Account have no cash value and can not under any circumstances whatsoever be redeemed for cash or used as payment for obligations to National City. The Program is void where prohibited by law.

8.  National City is solely responsible for reporting your annual eScrip Visa donations to eScrip after each December’s credit card Account statement period has cycled.  Once transferred, eScrip is solely responsible for all donation processing to award your eScrip Visa donations to your chosen organization.

9.  You are responsible for determining any tax benefit or liability for your eScrip Visa Program Account.

10.  Neither National City nor eScrip shall be liable for any damage or other loss to person or property or any expense, or inconvenience of any type or nature that may result from your participation in the Program.
